Who you are buying from

These terms apply to every order paid through an ElBay payment page. The seller of record for your order is [LEGAL NAME], registered office [REGISTERED ADDRESS] ("ElBay", "we"). ElBay contracts with you, collects your payment and arranges delivery.

The products are made or supplied by independent businesses based in Algeria that use ElBay to sell abroad ("the merchant"). The merchant prepared your order and will hand it to DHL for delivery.

How your order is made

The merchant prepares your order and sends you a link to its ElBay payment page. On that page you can review the items and their prices, enter or confirm your delivery details and see the shipping price DHL quotes for your address.

The contract between you and ElBay is formed when your payment is confirmed to us by our payment provider. Returning to the payment page from the payment form is not by itself a confirmation: the page shows your order as paid only once we have received that confirmation.

Prices and payment

Prices are shown in the currency of the payment page. The total you pay is shown before you pay and includes the products, the shipping and, where the page says so, the import duties and taxes. A shipping quote is valid until the time shown on the page; after that a new quote is needed.

Payment is taken by Stripe on its secure payment page. ElBay never receives or stores your card number. A payment link is valid for a limited time and for one order only.

Delivery

Orders are shipped from Algeria by DHL Express to the address you give. Delivery times are DHL's estimates and are not guaranteed; customs clearance can add time. Once your parcel is shipped we send you its tracking number.

Please check your delivery details carefully: we cannot be responsible for a parcel delivered to an address you gave incorrectly. Our shipping, duties and taxes policy gives the details.

Import duties and taxes

Your order may be subject to import duties, taxes and customs fees in your country. The payment page says, before you pay, whether these are included in your total or will be collected from you on delivery by DHL or the customs authorities.

The products

Product descriptions and pictures are provided by the merchant. Many products are made by hand, so small differences in colour, size or finish from the pictures are normal and are not a defect.

Returns and refunds

We do not accept returns for a change of mind. We refund you if your order arrives damaged, if it is lost in transit, or if we cannot ship it after you have paid, as set out in our returns and refunds policy.

Nothing in these terms excludes or limits any right you have under the mandatory consumer protection law of the country where you live.

Our liability

We are responsible for losses that are a foreseeable result of our failure to meet these terms. We are not responsible for losses that were not foreseeable, for business losses, or for delays caused by events outside our control, including customs inspections.

Nothing in these terms limits our liability where the law does not allow it to be limited, including for fraud or for death or personal injury caused by negligence.

Your personal data

We use your personal data to process, deliver and support your order, as described in our privacy policy.

Questions and complaints

Write to support@elbay.online with your order number. We answer every message and try to resolve complaints quickly. Please contact us before disputing a payment with your bank, so that we can help.

Law and disputes

These terms are governed by [GOVERNING LAW], and disputes are heard by [COMPETENT COURTS]. If you are a consumer, this does not deprive you of the protection of the mandatory rules of the country where you live, or of your right to bring a claim in its courts.

We may update these terms. The version in force on the day you pay applies to your order.
